Fired Contractor Wins $38M Verdict Against Newark, Del.

A Bucks County, Pa., contracting firm was awarded more than $38.4 million last week in its suit against the city of Newark, Del., for terminating its contract to build a reservoir and later tarnishing its reputation by accusing the contractor of quitting the job.

In the suit, Donald M. Durkin Contracting Inc. of Southampton, Pa., claimed its contract to build a 318-million gallon reservoir was terminated after it raised concerns about whether the reservoir could be built as designed.

Plaintiffs attorney Paul A. Logan of Powell Trachtman Logan Carrle & Lombardo in King of Prussia told the Delaware federal court jury that Newark city officials refused to address the problems and instead set out to ruin Durkin's reputation and interfere with its ability to obtain additional jobs.

WHITE PLAINS, N.Y., Sept. 20 -- Jason D. Lippert, President and CEO of Lippert Components, Inc., a subsidiary of Drew Industries Incorporated , was elected on Friday to the board of directors of the Recreational Vehicle Industry Association (RVIA).

Jason's experience and knowledge of the RV industry will be a key resource for both the RVIA and the industry at large."

Lippert, 34, will serve a two-year term on the board, representing suppliers to the recreational vehicle (RV) industry. Since 2003, he has served as president and CEO of Lippert Components. Prior to this position, Lippert served as executive vice president and chief operating officer of Lippert Components from 2000-2003, and as regional director of operations from 1998- 2000.


EDITORIAL: Tax relief for recovery

The Legislature should reach fast conclusions about a proposed sales tax break on modular homes, especially to help reconstruction in Hurricane Katrina-ravaged Gulf Coast counties.
Barbour has set a special session for noon Thursday, and he seeks a sales tax reduction on modular home materials from 7 percent to 3 percent.
The Coast needs up to 100,000 new residences to replace homes destroyed or irreparably damaged by Hurricane Katrina in August 2005. Modular homes are partially assembled off-site, shipped and assembled on residential property. They are widely viewed as at least a partial and faster remedy in the home replacement market.
An earlier special session adjourned without passing the modular home tax reduction, with House of Representatives leaders saying the needed more time to fully analyze the proposal and its budget impact.
